Welcome to golden eyes project. These Website & Shop Terms (“Terms”) govern your use of the golden eyes project website, including its pages, forms, online gallery, shop, artwork commission features, programs, resources and other services made available through the website (collectively, the “Site”).

golden eyes project (“gep,” “we,” “us,” or “our”) is operated by golden eyes project foundation, a nonprofit public charity. By accessing or using the Site, submitting information through the Site, or making a purchase through the Site, you agree to these Terms and any policies referenced within them.

If you do not agree to these Terms, please do not use the Site.

1. Our Mission & Website

golden eyes project harnesses art and design to raise resources, increase awareness and create opportunities that uplift children and communities. The Site supports this mission by providing information about gep, its programs and partnerships and by facilitating creative participation, charitable giving, artwork contributions, commissions, purchases and other forms of engagement.

Information provided through the Site is intended for general informational and organizational purposes. We may update, expand, modify or discontinue portions of the Site as gep and its programs develop.

2. Eligibility & Use of the Site

You may use the Site only for lawful purposes and in a manner consistent with these Terms.

You agree not to misuse the Site, interfere with its operation or security, attempt to gain unauthorized access to the Site or related systems, submit false or misleading information, impersonate another person or organization, or use Site content in a manner that infringes the rights of gep, participating creators or others.

Certain activities available through the Site may have additional eligibility requirements or terms. Participation in a gep program, internship, volunteer role, creator relationship, artwork contribution or other formal relationship may require completion of separate forms, agreements, permissions or authorization.

3. Children & Young People

Some gep initiatives are intentionally designed to benefit and engage children and teenagers. However, access to the public website does not by itself authorize a minor to participate in a gep program or activity requiring parental or guardian permission.

Where parental or guardian authorization is required, gep will seek the appropriate consent before a minor participates or before information, images, recordings or other materials requiring such authorization are collected or used.

Purchases, charitable contributions, contractual submissions and other transactions that require legal capacity should be completed by an adult or with appropriate adult authorization.

Additional requirements concerning information collected from or about children are addressed in our Privacy Policy and applicable program-specific materials.

4. Artwork, Creators & the Online Gallery

The Site may display original artwork, commissioned artwork, prints, merchandise and other creative works contributed to or offered in collaboration with gep.

Ownership of an original physical artwork does not necessarily include ownership of the copyright or other intellectual-property rights associated with that work. Unless expressly stated otherwise in an applicable agreement or product description, copyrights and other intellectual-property rights remain with their respective rights holders.

Artwork availability may change without notice. Placement of an artwork or creator profile on the Site does not guarantee that a particular work will remain available for purchase, commission or other participation.

Creator participation, artwork contributions and commissioned work may be governed by separate agreements between gep and the applicable creator, collector, donor or other participant. Where a separate agreement applies, that agreement governs the relationship addressed by it.

5. Artwork Commissions

The Site may allow visitors to inquire about or request custom artwork from participating creators. Submission of a commission request does not, by itself, create a binding commission or guarantee that a creator will accept the project.

Commission details, pricing, payment schedules, timelines, modifications, fulfillment and other applicable requirements will be established through the relevant commission process and agreement.

Because commissioned artwork is created specifically for an individual purchaser, additional limitations concerning cancellation, modification, returns or refunds may apply and will be disclosed through the applicable agreement or policy.

6. Purchases & Payments

Prices and availability displayed through the Site are subject to change before a transaction is completed. Applicable shipping charges, taxes or other costs may be added where required.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges associated with your transaction.

Payments may be processed through third-party payment providers. gep does not necessarily receive or retain complete payment-card information submitted directly through those providers. Use of third-party payment services may also be subject to the provider’s own terms and privacy practices.

We reserve the right to decline or cancel a transaction when reasonably necessary, including because of pricing or listing errors, suspected fraud, inability to fulfill an order or other legitimate operational concerns. If gep cancels a completed paid transaction, amounts due for refund will be handled appropriately.

7. Shipping, Delivery, Returns & Refunds

Shipping, delivery, returns, cancellations and refunds are governed by our Returns, Refunds & Shipping Policy, together with any additional terms disclosed for a particular artwork, commission or product.

Original and commissioned artwork may require specialized packing, shipping, insurance or professional fulfillment procedures. Delivery estimates are estimates rather than guarantees unless expressly stated otherwise.

Purchasers are responsible for providing accurate and complete delivery information and for promptly notifying gep of relevant delivery issues.

8. Charitable Contributions

Monetary contributions made to gep are intended to support the organization and its charitable mission. Unless expressly stated otherwise, a contribution does not constitute the purchase of goods or services.

Charitable contributions and other gifts may be subject to our Donation & Gift Acceptance Policy and applicable law.

Donors are responsible for consulting their own tax or financial advisors regarding the deductibility or tax treatment of any contribution. Any acknowledgment provided by gep is intended to document the transaction and should not be interpreted as individualized tax advice.

Artwork contributions are governed separately through gep’s applicable artwork contribution documentation.

9. Intellectual Property

Unless otherwise indicated, the Site and its original content, including gep-created text, graphics, branding, design elements, program materials and other content, are owned by or licensed to golden eyes project foundation and are protected by applicable intellectual-property laws.

The Site also contains artwork, photographs, writing and other materials owned by participating artists, creators, contributors or other third parties. Display of those materials on the Site does not place them in the public domain or grant visitors permission to reproduce, distribute, sell, modify or otherwise exploit them.

You may view and share links to publicly available Site pages for personal, informational and noncommercial purposes. Any broader reproduction or commercial use requires appropriate permission from the applicable rights holder.

10. User Submissions

The Site may allow visitors to submit forms, applications, inquiries, written materials, photographs, artwork information, portfolio materials, ideas or other content.

You retain ownership of content you submit unless a separate agreement provides otherwise.

By submitting content for the purpose of being displayed, evaluated, processed or used in connection with a request or participation opportunity, you grant gep permission to access, reproduce and use that content to the extent reasonably necessary to process the submission and carry out the purpose for which it was provided.

Submission through a general website form does not, by itself, give gep unrestricted ownership or public-use rights to your content. Broader permissions for publication, marketing, artwork reproduction, creator profiles or similar uses will be governed by the applicable form, permission or separate agreement.

You represent that you have the right to provide the material you submit and that doing so does not knowingly violate another person’s rights.

11. Creator Profiles, Images & Portfolio Materials

Creators who choose to participate with gep may authorize gep to display approved names, biographies, images, artwork, portfolio materials, social links and related information through creator profiles and promotional materials.

The scope of those permissions is governed by the applicable creator onboarding materials and agreements. Nothing in these Terms expands permissions beyond those separately granted by a creator or rights holder.

12. Third-Party Links & Services

The Site may contain links to third-party websites, platforms, social networks, payment providers, partner organizations or other external services.

These services are operated independently of gep. A link or reference does not necessarily constitute endorsement of all content, practices or activities of a third party.

gep is not responsible for the privacy practices, terms, availability or content of independently operated third-party services. Visitors should review the applicable terms and policies before using those services.

13. Program & Partnership Information

Descriptions of gep programs, pilots, partnerships, opportunities, goals and anticipated activities reflect the organization’s plans and operations at the time they are published.

Because gep is a developing nonprofit organization, program structures, timelines, participation opportunities, resources, partnerships and goals may evolve as programs are tested and refined. Publication of anticipated programming or partnership opportunities does not guarantee that a particular activity, benefit, resource or opportunity will be available.

Where participation requires a separate agreement, authorization or eligibility determination, information on the Site does not replace those requirements.

14. Accuracy & Availability

We make reasonable efforts to maintain accurate and useful information on the Site but cannot guarantee that every page will always be complete, current or error-free.

We may correct errors, update information, change availability or temporarily restrict access to portions of the Site when reasonably necessary.

15. Privacy

Our collection, use and handling of personal information through the Site are described in our Privacy Policy.

By submitting information through the Site, you acknowledge that information will be handled in accordance with that policy and any additional notices or permissions presented at the point of collection.

16. Disclaimer of Warranties

To the extent permitted by applicable law, the Site and its publicly available content are provided on an “as is” and “as available” basis.

gep does not warrant that the Site will always be uninterrupted, error-free or free from harmful components, or that every piece of information available through the Site will remain current.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the extent permitted by applicable law, golden eyes project foundation and its directors, officers, employees, volunteers and authorized representatives will not be liable for indirect, incidental, special, consequential or similar damages arising solely from use of, or inability to use, the Site.

Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.

Counsel review requested: gep specifically requests review of this section to determine appropriate limitations for its nonprofit, e-commerce, artwork and youth-program activities.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses or expenses arising from your unlawful misuse of the Site, your material violation of these Terms or content you submit in violation of another person’s rights.

19. Governing Law & Disputes

These Terms and disputes arising from use of the Site will be governed by applicable law.

Counsel review requested: golden eyes project foundation is incorporated in Delaware and operates in Florida. Counsel should advise gep regarding the appropriate governing-law, venue and dispute-resolution provisions for its website, e-commerce and nationwide activities before this section is finalized.

20. Changes to These Terms

We may update these Terms as the Site, organization, programs or legal requirements evolve. When changes are made, the “Last Updated” date at the top of this page will be revised.

Material changes may also be communicated through additional notice when appropriate.

Continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
